SB 1243 – Tenant Protections for Immigrant Families Act

What is this bill about?

SB 1243 establishes eviction protections for immigrant households who are impacted by ICE kidnapping (including those living in mobile homes).

How does it align with yli’s values?

Beginning in January 2025, federal Immigration and Customs Enforcement (ICE) and the U.S. Department of Homeland Security (DHS) have significantly increased military-style roving patrols and detentions. Since then, about 10,000 people in California have been detained by ICE. As a result, many immigrant tenant households are facing economic troubles and housing instability with the detention of household members, especially the leaseholder.

SB 1243 seeks to keep families in their homes by:

  • Permitting tenants to raise a detention-related hardship as an affirmative defense in an unlawful detainer proceeding for nonpayment of rent and seek a temporary stay.
  • Ensuring that eviction notices include a self-declaration form that tenants can fill out stating the household is experiencing a detention-related hardship. 
  • Establishing guardrails on fees for the late payment of rental debt.
