What is this bill about?
AB 1464 would deny some incarcerated transgender, gender-diverse, and intersex (TGI) people the ability to access housing that aligns with their gender identity. Instead, it require these individuals to be housed in a facility āconsistent with the individualās anatomyā if the individual has been convicted of certain offenses.
Why doesn’t it align with yliās values?
CDCR has a demonstrated record of failing to protect the most vulnerable people in its custody. Transgender people are especially vulnerable to gender-based violence and isolation in prison. For transgender women housed in CDCR facilities for men, the risk of experiencing targeting, physical and sexual violence, and isolation is extremely high. A study of California state prisons designated for men found that the rate of sexual assault for transgender women in those prisons was 13 times higher than for men in the same prisons.
To ensure safety for TGI people, who face horrific rates of violence in prisons, CDCR must actually implement the bill and house TGI people in the respective gender-designated facility where they feel safest. Blanket policies like AB 1464 that deny housing options to transgender people based solely on their gender and conviction histories are inherently discriminatory and should be rejected.
